Brand Ownership
Aston Pharma® and Aston Workwear® are brands owned by Astflick Holdings Ltd and used under licence by Astflick Group Ltd.
Astflick Group Ltd is the contracting entity for all sales and orders covered by these Terms.
1. Definitions
1.1 “We”, “us”, “our”, “Aston Pharma” and “Aston Workwear” mean Astflick Group Ltd trading under the relevant brand name.
1.2 “Brand Owner” means Astflick Holdings Ltd.
1.3 “Consumer” means an individual acting for purposes wholly or mainly outside their trade, business, craft or profession.
1.4 “Business Customer” means a customer purchasing for purposes wholly or mainly connected with their trade, business, craft or profession.
1.5 “Customer”, “you” and “your” mean the person or organisation purchasing Goods from us.
1.6 “Goods” means the products supplied by us. “Terms” means these Terms & Conditions.
1.7 Please provide accurate information about whether you are purchasing as a Consumer or Business Customer. Your legal status depends on the circumstances of the purchase, rather than a label alone.
2. Orders & Contract Formation
2.1 These Terms apply to orders placed through our website or by email, telephone or post, where made available to you before the contract is formed.
2.2 For Business Customers, these Terms apply in preference to purchasing terms proposed by the Customer unless we expressly agree otherwise in writing.
2.3 Placing an order constitutes an offer to purchase the Goods. An automated acknowledgement or payment receipt confirms receipt of the order only and does not constitute acceptance. Unless we expressly accept your order earlier in writing, a contract is formed when we dispatch the Goods and send confirmation of dispatch.
2.4 Before acceptance, we may decline or limit an order, including where Goods are unavailable or a listing contains an error. Any payment taken for Goods we do not accept for supply will be refunded in full.
2.5 If we identify an error in the price, description, pack size or quantity before acceptance, we will explain the correction and ask whether you wish to proceed. We will not increase the price or supply a materially different product or quantity without your agreement.
2.6 Once a contract is formed, we will not change its price or material specifications without your agreement. Any cancellation by us must be permitted by the contract or applicable law.
3. Prices & VAT
3.1 Prices are quoted in pounds sterling. Business prices may be displayed exclusive of VAT where clearly stated. Where Goods are offered to Consumers, the total price payable, including applicable VAT and mandatory charges, will be displayed before the order is placed.
3.2 VAT is charged at the applicable rate unless a valid exemption applies and the required evidence is provided.
3.3 The price payable is the price agreed when we accept your order, subject to any correction expressly agreed before acceptance.
3.4 Published prices may change before an order is accepted. Changes do not retrospectively alter an existing contract.
3.5 An incorrect or outdated website price does not, by itself, oblige us to accept an order at that price or create an automatic entitlement to a price adjustment, partial refund, account credit or additional Goods. Where an error is discovered after a contract has been formed, we will contact you to agree a resolution, subject to your applicable legal rights.
4. Payment
4.1 Payment is required before dispatch unless we have approved a credit account or agreed otherwise in writing. Available payment methods are shown at checkout or confirmed when the order is placed.
4.2 Business credit facilities are subject to approval. Approved account terms are seven days from the invoice date unless otherwise agreed in writing.
4.3 For overdue qualifying business debts, we may claim statutory interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998, together with any additional recovery costs recoverable under applicable law.
4.4 Where payment is overdue, we may suspend further deliveries or credit facilities to the extent permitted by the contract and applicable law.
4.5 Card payments are processed through our payment providers. We do not store full credit or debit card details. Information about personal data processing is set out in our Privacy Policy.
5. Delivery
5.1 Standard delivery is normally three to five working days from dispatch unless otherwise stated. Delivery estimates are not guaranteed unless we expressly agree a guaranteed date.
5.2 Orders received after 3:00pm, at weekends or on public holidays will normally be processed on the next working day.
5.3 Standard delivery charges, subject to the delivery area and service shown before ordering, are:
- Free standard delivery on orders of £75.00 or more, excluding VAT.
- £8.95 excluding VAT on orders below £75.00, excluding VAT.
- Delivery to the Republic of Ireland, Scottish Highlands and international destinations is quoted separately and agreed before the order is placed.
5.4 Please provide a complete and accurate delivery address. Additional costs arising from an incorrect address supplied by you may be charged where reasonable and permitted by law.
5.5 If an event outside our reasonable control affects delivery, we will notify you and take reasonable steps to minimise the delay. This does not remove any cancellation or refund rights available under applicable law.
5.6 For Business Customers, risk passes on delivery to the agreed address. For Consumers, risk normally passes when you, or a person you nominate, take physical possession of the Goods. Different statutory rules may apply where you independently appoint a carrier we have not offered.
5.7 Please inspect deliveries promptly and report visible damage or shortages within five working days where reasonably possible. Please report a missing delivery within ten working days of the expected delivery date. These reporting requests do not remove applicable legal rights.
5.8 Please request proof of delivery within two months of the invoice date where possible, as carrier records may be available for a limited period.
5.9 For Consumers, unless another delivery period is agreed, we will deliver without undue delay and within 30 days of the contract being formed. Statutory rights concerning late or failed delivery remain unaffected.
6. Retention of Title
6.1 Ownership of the Goods passes when we receive full payment in cleared funds.
6.2 Until ownership passes, Business Customers must store the Goods safely and keep them identifiable as our property. They must not resell or dispose of unpaid Goods unless we agree otherwise in writing.
7. Product Information & Listing Errors
7.1 We take reasonable care to ensure that descriptions, prices, specifications, pack sizes and quantities are accurate. Errors may nevertheless occur, and we will correct them when identified.
7.2 Minor changes to packaging or presentation may occur, provided they do not materially alter the Goods or their agreed specification.
7.3 We will obtain your agreement before supplying a substitute that materially differs from the product ordered.
7.4 If Goods supplied appear to differ from the agreed description, price, pack size or quantity, please contact us promptly with your order number and details of the discrepancy.
7.5 A listing error does not automatically entitle a customer to retain the Goods and receive a partial refund, account credit, price reduction or additional Goods. Such an adjustment must be agreed with us, unless the customer is entitled to it under applicable law.
7.6 Where we confirm a material listing error affecting Goods already delivered, we will offer the option to return the affected Goods for a full refund of the amount paid for them or, with your agreement, a full account credit. We will arrange or reimburse reasonable return costs. No restocking fee will apply. Any delivery charges refundable under applicable law will also be refunded.
7.7 Please contact us before returning Goods so that we can provide appropriate instructions. Where reasonably possible, keep the Goods unused and retain their original packaging, including sterile seals. These requests do not restrict applicable rights or remedies.
7.8 Returning Goods under clause 7.6 is an offered resolution, not an exclusive remedy where applicable law provides another remedy.
7.9 Goods must be stored, handled and used in accordance with the manufacturer's instructions, expiry dates and applicable professional requirements.
8. Consumer Customers
8.1 Nothing in these Terms excludes or restricts your statutory rights as a Consumer, including rights concerning Goods that are faulty, unsuitable or not as described.
8.2 For qualifying online, telephone and mail-order purchases, you may cancel without giving a reason within 14 days after taking delivery. Where a single order is delivered in separate parts, the applicable cancellation period normally runs from receipt of the last part.
8.3 To cancel, notify us using the contact details on our website or write to our registered office. A clear statement identifying your order and your decision to cancel is sufficient. You may use the cancellation form below, but this is not compulsory.
8.4 Unless we offer to collect the Goods, return them within 14 days after notifying us of cancellation. You bear the direct return cost for a change-of-mind cancellation where we have informed you of that obligation before the contract is formed.
8.5 For a valid cancellation, we will refund the payments due, including standard outbound delivery where required. We do not have to refund the additional cost of a premium delivery option above our least expensive standard delivery service.
8.6 Refunds will be made without undue delay and within the applicable statutory period. Unless we offer collection, we may withhold a cancellation refund until we receive the Goods or evidence that you have sent them back, whichever is earlier. We will then refund within 14 days of that event. If no Goods were supplied, or we offer collection, the refund deadline is normally 14 days after notification of cancellation.
8.7 Refunds are made using the original payment method unless you expressly agree otherwise. No refund fee will be charged.
8.8 For change-of-mind returns, we may make a lawful deduction for diminished value caused by handling beyond what is necessary to establish the nature, characteristics and functioning of the Goods. Original packaging is requested where possible, but is not a blanket condition of statutory rights.
8.9 Exceptions to cancellation rights are explained in section 10. These exceptions do not remove rights concerning faulty or misdescribed Goods.
8.10 If Goods are faulty or do not conform to the contract, your legal remedies may include rejection, repair, replacement or a price reduction, depending on the circumstances. We will bear reasonable return costs where required by law.

9. Business Customers
9.1 Business Customers do not have the Consumer change-of-mind cancellation rights described in section 8. This does not remove rights concerning breach of contract or Goods that do not conform to the agreed description or specification.
9.2 Change-of-mind returns by Business Customers are accepted at our discretion and require prior written authorisation.
9.3 Unless otherwise agreed, authorised change-of-mind returns must be unused, in saleable condition and in their original packaging, with sterile or hygiene seals intact where applicable. Return costs are payable by the Customer.
9.4 A restocking charge of 20% of the returned Goods' price, subject to a minimum of £5 per item, may apply to discretionary change-of-mind returns. Any charge will be confirmed before you agree to the return.
9.5 The discretionary conditions and restocking charges above do not apply to returns under clause 7.6 or where inconsistent with your applicable legal rights.
9.6 Returned Goods may be inspected or tested. If an investigation finds no fault or contractual discrepancy, reasonable inspection, collection or redelivery charges may apply only where agreed in advance or otherwise lawfully recoverable.
10. Restricted & Non-Returnable Items
10.1 For Business Customer change-of-mind returns, the following categories are normally excluded unless we agree otherwise in writing:
- Medical products and sutures.
- PPE, including face masks.
- Single-use items.
- Clearance Goods.
- Special-order Goods.
- Customised or embroidered Goods.
10.2 For Consumers, statutory change-of-mind cancellation exceptions apply only where the legal conditions are met. Relevant examples include:
- Goods made to your specifications or clearly personalised.
- Sealed Goods unsuitable for return for health protection or hygiene reasons, where unsealed after delivery.
- Goods liable to deteriorate or expire rapidly.
10.3 A product is not automatically excluded from Consumer cancellation rights simply because it is a medical, clearance or special-order item.
10.4 This section does not prevent a return offered under clause 7.6 or restrict rights concerning faulty, misdescribed or otherwise non-conforming Goods.
11. Payment Disputes & Chargebacks
11.1 If you have a payment or order concern, please contact us so that we can investigate. This does not restrict your right to contact your bank, payment provider or another appropriate body.
11.2 A chargeback or payment reversal does not, by itself, determine whether the underlying contract has been cancelled or whether a payment remains legally due.
11.3 Where payment is reversed, we may request information and suspend further credit or deliveries where permitted by the contract and applicable law.
11.4 We may seek payment or recovery costs only to the extent legally due. We will not require payment for Goods where you have validly exercised a right to reject or cancel, or where another legal defence or remedy applies.
11.5 We may decline future orders or withdraw discretionary credit facilities following substantiated fraudulent or abusive activity. Existing contractual and statutory rights remain unaffected.
12. Website Use & Intellectual Property
12.1 General website information does not replace product-specific instructions, manufacturer guidance or appropriate professional advice. This does not exclude responsibility for contractual product descriptions or representations.
12.2 Aston Pharma® and Aston Workwear® are brands owned by Astflick Holdings Ltd and used under licence by Astflick Group Ltd.
12.3 Website text, images, branding and other content are protected by applicable intellectual property rights belonging to us, the Brand Owner or relevant licensors.
12.4 You may view and print content for personal or internal business reference. Reproduction, redistribution or commercial exploitation requires permission unless otherwise permitted by law.
12.5 You must not misuse the website, introduce malicious software, attempt unauthorised access or interfere with its operation.
13. Third-Party Links
13.1 Links to third-party websites are provided for convenience. We do not control those websites and are not responsible for their content or services, except where applicable law provides otherwise. A link does not necessarily imply endorsement.
14. Liability
14.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited.
14.2 For Business Customers, subject to clause 14.1 and any applicable statutory reasonableness requirement, our total liability arising from an order is limited to the total price paid or payable for the Goods under that order.
14.3 For Business Customers, subject to clause 14.1 and any applicable statutory reasonableness requirement, we exclude liability for indirect or consequential losses and for loss of profit, revenue, business opportunity or business interruption.
14.4 Clauses 14.2 and 14.3 do not apply to Consumers. For Consumers, we are responsible for loss or damage that is a foreseeable result of our breach of contract or failure to use reasonable care and skill, subject to applicable law.
15. Data Protection
15.1 Personal data is processed in accordance with applicable UK data protection law, including the UK GDPR and Data Protection Act 2018, as amended.
15.2 Our Privacy Policy explains how we collect, use, retain and share personal data and how individuals may exercise their rights.
16. Governing Law & Jurisdiction
16.1 These Terms and contracts governed by them are governed by the laws of England and Wales.
16.2 For Business Customers, the courts of England and Wales have exclusive jurisdiction over disputes arising from these Terms or the relevant contract.
16.3 For Consumers, this clause does not remove mandatory legal protections or rights to bring proceedings in another court available under applicable law, including relevant rights in your place of residence.
17. Changes to These Terms
17.1 We may update these Terms from time to time. The version made available to you when you place your order will apply to that order unless a subsequent change is expressly agreed with you.
17.2 Updates do not retrospectively alter existing contracts. Revised website-use provisions apply to future website use to the extent lawfully incorporated and enforceable.
18. Acceptance & General Provisions
18.1 By placing an order, you agree to these Terms where they have been made available to you before the contract is formed. Please retain a copy for your records.
18.2 If a provision is found unlawful or unenforceable, the remaining provisions continue to apply to the extent permitted by law.
18.3 A delay in exercising a right does not, by itself, waive that right.
18.4 For order queries, complaints or return requests, please use the contact details published on our website or write to our registered office shown above.
Your Legal Rights
Nothing in these Terms excludes or restricts any right or remedy that cannot lawfully be excluded or restricted. Consumer and Business Customer rights differ, and the applicable rights depend on the circumstances of the purchase.
